PartyRide Terms & Conditions

These Terms & Conditions (“Terms”) constitute a binding agreement between you and PartyRide, Inc. (“PartyRide,” “we,” “us,” or “our”) governing your use of the PartyRide mobile applications, websites, QR/event tools, and related services (collectively, the “Platform”). By creating an account, accessing, or using the Platform, you agree to these Terms.
Note: PartyRide is a technology platform; PartyRide does not provide transportation services and is not a common carrier. Transportation is provided by independent, third-party drivers (“Drivers”) using the Platform.
1) Key Definitions
- Rider: A user who requests, joins, or pays for transportation.
- Primary Requester (Host): The Rider who creates a group ride and configures split-payment settings.
- Share: A Rider’s financial portion of a fare (fixed or %).
- Event/QR Ride: Venue or driver-initiated ride where Riders scan a QR to join and pay.
- TNC: “Transportation Network Company,” as defined by applicable law (e.g., Texas Insurance Code Ch. 1954).
2) Eligibility; Account; Verification
You must be at least 18 and legally able to enter contracts. Provide accurate information and keep your credentials secure. We may require identity checks/KYC for fraud or safety. We may deny or revoke access for policy or safety reasons.
3) Consent to Electronic Communications & SMS (TCPA/CTIA)
By providing a phone number, you consent to receive transactional texts (e.g., codes, ride status) and, if you opt in, marketing texts. Message/data rates may apply. For marketing texts, reply STOP to opt out; HELP for help. We maintain consent records and follow TCPA/FCC rules and CTIA messaging best practices.
4) Booking, Group Rides & Split Payments
4.1 Booking. You may request immediate or scheduled rides; estimates (fare/ETA) are not guaranteed. The Platform may show capacity and vehicle type (e.g., SUV, minibus).
4.2 Group Rides. The Primary Requester can invite others via link/QR and set equal or custom splits. Each Rider must authorize their Share before pickup unless the Host elects to cover unpaid Shares. Unpaid Shares may trigger auto-cancellation per policy.
4.3 Event/QR Mode. At venues or events, Riders can join by scanning a QR, complete a light onboarding, and pay a fixed or metered Share. Drivers/venues may set a boarding timeout; late joiners may be denied if seats are full.
4.4 Responsibility for Shares. Each Rider is responsible for their own Share. The Host remains a fallback payer for any invited guest who fails payment (if Host enabled that setting). Refund/credit outcomes depend on cancellation windows and actual service rendered.
5) Pricing, Fees, Payments & Refunds
5.1 Payments. We use third-party payment service providers (PSPs) for authorization/capture, refunds, and chargebacks. You authorize charges to your chosen method (card/wallet).
5.2 Charges. Charges may include base fare, distance/time, tolls, surcharges, split fees, service fees, venue fees, cleaning/damage fees (if applicable), and taxes. Tips are voluntary unless a venue-specific policy states otherwise.
5.3 Pre-Authorizations & Escrow. We may pre-authorize payment for your Share; capture occurs on completion or per Event/QR rules. Declined payments may lead to cancellation, debt collection, and account restrictions.
5.4 Cancellations & No-Shows. Fees may apply if you cancel beyond the grace window or fail to appear. Event/QR rides may lock seats at payment; no-show refunds may be limited.
5.5 Refunds/Disputes. Where eligible, refunds are returned to the original payment method. Chargeback abuse may lead to account action.
6) Safety & Conduct
6.1 Rider Conduct. Be respectful; follow Driver instructions related to safety; no open containers (where prohibited), weapons, or harassment. Seatbelts required.
6.2 SOS & Emergency. The app may include an SOS feature to escalate to support/emergency contacts. For emergencies, call 911. SOS tools are provided “as is.”
6.3 Zero-Tolerance. Zero tolerance for impaired driving, violence, or harassment. Drivers and Riders who violate safety policies may be suspended or removed.
6.4 Accessibility & Non-Discrimination. PartyRide prohibits discrimination. Service animals must be accommodated per applicable law. Reasonable best efforts apply to wheelchair-accessible options.
7) Lost & Found
Report items via the app. PartyRide is not liable for lost property. Fees may apply for return trips or time.
8) Insurance & Risk Allocation
8.1 TNC Insurance Framework. When Drivers are logged into the Platform and/or performing a prearranged ride, primary automobile insurance must be in force in the amounts required by applicable state law (e.g., Texas Insurance Code Ch. 1954, including coverage by Periods). Coverage may be maintained by the Driver or by PartyRide on the Driver’s behalf, subject to law.
8.2 Your Coverage. You are encouraged to maintain appropriate personal insurance. PartyRide does not insure your personal property.
8.3 Disclaimer. Insurance terms vary by state, city, and period (logged in; en-route; on-trip). Coverage details, limits, and carriers may change and will be disclosed in your city’s Insurance Summary.
9) Platform Rules; Third-Party Services
You agree not to misuse the Platform (no scraping, reverse engineering, fraud, or unlawful conduct). The Platform may link to third-party services (maps, payments, messaging). PartyRide is not responsible for third-party terms or outages.
10) Intellectual Property
The Platform and all content are owned by PartyRide or its licensors and protected by IP laws. We grant you a limited, revocable, non-exclusive license to use the Platform for its intended purpose.
11) Ratings, Reviews, and Content
You may submit feedback, ratings, or comments. You grant PartyRide a worldwide, royalty-free license to use such content for Platform purposes. Do not submit illegal, infringing, or harmful content.
12) Privacy
Your use is also governed by the PartyRide Privacy Policy, which explains what data we collect and how we use it (including device, location, telematics, and communications metadata). The Privacy Policy is incorporated herein by reference.
13) Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” PARTYRIDE DISCLAIMS ALL WARRANTIES NOT EXPRESSLY REQUIRED BY LAW. WE DO NOT GUARANTEE AVAILABILITY, ERROR-FREE OPERATION, PERFECT ETA ACCURACY, OR ANY SPECIFIC OUTCOME.
14) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTYRIDE AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, NOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE PLATFORM. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU FOR THE RIDE(S) AT ISSUE IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) $100.
15) Indemnification
You agree to defend, indemnify, and hold harmless PartyRide, its affiliates, officers, employees, and agents from claims arising out of: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of law or third-party rights.
16) Dispute Resolution; Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. It affects your legal rights.
16.1 Binding Arbitration. You and PartyRide agree to resolve any dispute arising from or relating to these Terms or the Platform through final and binding arbitration under the Federal Arbitration Act (FAA), administered by JAMS (or, if unavailable, AAA) under its consumer rules. No judge or jury.
16.2 Class & Representative Action Waiver. You and PartyRide agree to bring claims only individually, not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. (Courts have upheld the use of arbitration/class-action waivers in ride-share terms—major platforms use similar provisions, often with an opt-out.)
16.3 Opt-Out. You may opt out of this arbitration agreement within 30 days of accepting these Terms by sending a written notice with your name, the email tied to your account, and a clear statement of your intent to opt out to: legal@party-ride.com or PartyRide, Inc., ATTN: Arbitration Opt-Out, support@party-ride.com. (Many platforms offer a 30-day opt-out window; we mirror that approach.)
16.4 Small Claims Exception. Either party may bring an individual action in small claims court.
16.5 Venue & Law. Texas law governs these Terms, except that the FAA governs arbitration. For non-arbitrable claims, exclusive venue is state or federal courts located in Dallas County, Texas.
17) Term, Suspension & Termination
We may suspend or terminate access (with or without notice) for violations, safety, fraud, non-payment, or legal compliance. You may stop using the Platform at any time. Sections intended to survive termination do so.
18) Changes to Terms
We may update these Terms to reflect law or product changes. If we make material changes, we’ll provide notice (e.g., in-app, email). Continued use after the effective date constitutes acceptance.
19) State & Local Disclosures
Certain states or cities impose additional TNC requirements (insurance periods/limits, background checks, non-discrimination). PartyRide will maintain a City & State Disclosures page for applicable notices, including Texas Insurance Code Chapter 1954 insurance requirements for TNC drivers (logged-in, en-route, on-trip periods).
